Terms of Service

Welcome to Scull Fit. These Terms of Service ("Terms") govern your use of the Scull Fit mobile application (the "App") operated by ScatterLab (Pty) Ltd ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Scull Fit is a mobile application that uses artificial intelligence to generate personalized voice alarms. The App uses AI language models and text-to-speech technology to create unique alarm experiences.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Account Registration

To access certain features of the App, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update your account information as necessary
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Subscription Plans

Scull Fit offers subscription-based access to premium features. Subscription options and pricing are displayed within the App.

Billing

Subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

Auto-Renewal

Managing Subscriptions

You can manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of the current billing period.

Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not have direct access to process refunds for App Store purchases.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Generate content that is harmful, abusive, harassing, or objectionable
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our consent
• Circumvent any content-filtering techniques we employ

6. AI-Generated Content

The App uses artificial intelligence to generate voice alarm content. You acknowledge that:

• AI-generated content may occasionally be unexpected or imperfect
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• You are responsible for reviewing and using AI-generated content appropriately
• AI-generated content is provided for personal, non-commercial use only

7. Intellectual Property

The App and its original content, features, and functionality are owned by ScatterLab (Pty) Ltd and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services

The App integrates with third-party services including Google Gemini, ElevenLabs, Firebase, and RevenueCat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free. We do not guarantee that the App will wake you up on time or that alarms will function as expected in all circumstances.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCATTERLAB (PTY) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any failure of alarms to function as expected
• Unauthorized access to or alteration of your data
• Any third-party conduct or content
• Any other matter relating to the App

11. Indemnification

You agree to indemnify and hold harmless ScatterLab (Pty) Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScatterLab (Pty) Ltd regarding the App and supersede any prior agreements.
